Hire Terms & Conditions
By accepting delivery of any items hired from Seizure Alert Australia, referred to hereafter as “The Company,” the customer (referred to as “The Hirer”) agrees to the following terms and conditions:
1. Limitation of Liability
The Hirer agrees to indemnify The Company against all costs, losses, damages, or claims arising from or related to accidents, injuries, or property damage resulting from the use or misuse of hired equipment. This includes any third-party claims or expenses incurred during the hire period.
2. Use of Equipment
The Hirer agrees to:
- Use the equipment only for its intended purpose, following all provided user manuals, instructions, and safety guidelines.
- Keep batteries charged as specified when not in use.
- Immediately report any equipment malfunctions or issues to The Company.
- Accept responsibility for any damage caused to the equipment.
- Ensure the equipment remains at the delivery location unless prior approval for relocation is granted by The Company.
3. Security Deposit
A refundable security deposit equivalent to three (2) weeks’ hire is required for each item hired, unless waived for credit-approved customers.
- Deductions may be made for unpaid hire fees, return delivery charges, or damage repair costs.
4. Hire Period and Extensions
- The standard hire period is four (4) weeks, starting from the delivery date.
- Hire automatically extends by four (4) weeks unless the Hirer arranges for the return of the equipment.
- Extension charges are applied to the credit card or invoiced to the account on file.
5. Delivery and Postage Charges
- Delivery/postage fees are charged upfront and are non-refundable.
- Additional surcharges may apply for re-delivery or missed delivery windows.
Postage Pricing:
- Available upon request.
Surcharges:
- Re-delivery: 100% of the original delivery fee if delivery cannot be completed due to customer unavailability.
6. Payment and Refunds
- Payment is required in advance via credit card, cash, or approved plan manager.
- Hire charges recur every four (4) weeks until the equipment is returned.
- Refunds, including security deposits, will account for any unpaid hire, damage, or delivery fees.
7. Equipment Care and Maintenance
- The Hirer is responsible for the proper care, maintenance, and safe use of the equipment.
- Repairs must be conducted exclusively by The Company’s technicians.
8. Termination of Hire
The Company reserves the right to terminate the hire agreement and retrieve the equipment if payments are overdue or if the equipment is misused.
9. Purchase of Hire Items
Hired items may be purchased under the following conditions:
- For purchases within the first 4 weeks of hire, up to 2 weeks’ hire fees can be credited toward the purchase price.
- Beyond 4 weeks, 50% of the rental amount paid will be applied to the total purchase price.
10. Extended Hire Terms
For rentals, the following additional conditions apply:
- Title to the equipment remains with The Company.
- The Hirer is responsible for loss, theft, or damage to the equipment during the hire period.
- The equipment must pass inspection upon return, and repair or replacement costs for damages exceeding normal wear and tear will be billed to the Hirer.
11. Indemnity
The Hirer indemnifies The Company against any claims arising from the equipment’s use, including personal injuries or property damage.
12. Lost Equipment
Lost or stolen items will be charged at the full replacement cost as determined by The Company.
